We are one of very few accountancy practices in the UK to have been granted a licence to provide probate services, by the Institute of Chartered Accountants in England and Wales (ICAEW). We can offer a comprehensive, non-contentious, service without any need to involve a third party, simplifying the whole process for you as a result.

We also work closely with local partner firms who can provide support in the creation of a trust arrangement, which can be tailored to our client’s specific circumstances. This can realise a significant tax saving for the future.

What help can I receive?

Emma Newnham is our Head of Legal Sevices and, as such, can assist with as many, or as few, functions of the executor role as you wish. We undertake the role with the utmost sensitivity and discretion.

As part of our probate services, we can:

  • Administer the realisation of assets, including bank accounts, property and share portfolios.
  • Assist with the identification of assets and liabilities associated with an estate.
  • Carry out tasks on behalf of the executor.
  • Consider any Deed of Variation opportunities.
  • Distribute the assets of the estate according to the terms outlined in the deceased’s will or via intestacy.
  • Obtain Probate.
  • Prepare, and submit, any outstanding Personal Tax Returns up to the date of death.
  • Prepare estate tax returns and ensure all outstanding tax liabilities of the estate are settled, prior to its distribution.
  • Prepare the final estate accounts.
  • Provide advice on tax planning opportunities for the estate and/or beneficiaries who may be in charge of significant income, or assets, for the first time.
  • Provide ongoing Inheritance Tax and succession planning advice.

Probate fees

We will discuss the composition of the estate with you and the work required before providing you with a fixed fee quote. Our fees are based on an hourly rate and complexity of work.

Typical fees start from:

Preparation of probate application (PA1P) and IHT forms 205

  • if executors provide all information and valuations

From £600 + VAT

Preparation of probate application (PA1P) and IHT forms 400 and supplementary schedules

  • if executors provide all information and valuations

From £3,000 + VAT

Preparation of probate application (PA1P), IHT forms 400, supplementary schedules and full estate administration.

  • if executors provide all information and valuations

From £4,500 + VAT

We will also give you an indication of the timescales likely to be involved in the process including current timescales with third parties such as the probate office. 

Probate typically takes 9-12 months to settle an estate. However, it can sometimes take longer if, for example, there is a property to sell, complex Inheritance, Income or Capital Gains Tax affairs to resolve or there are complications regarding the personal representatives or beneficiaries of the estate.

Probate Services

  • In the unlikely event that we cannot meet our liabilities to you, you may be able to seek a grant from ICAEW’s Compensation Scheme. Generally, applications for a grant must be made to ICAEW within 12 months of the time you become aware, or reasonably ought to have been aware of the loss. Further information about the scheme and the circumstances in which grants may be made is available on ICAEW’s website at icaew.com/probate
  • If we do not deal with it within this timescale or you are unhappy with our response you may take the matter up with the ICAEW and the Legal Ombudsman. Complaints to the Legal Ombudsman should be made within six years of the of the act or omission or within three years of you becoming aware of the issue, and in either case within six months of our written response to your complaint to us. Professional indemnity insurance

As detailed in our standard terms of business we have professional indemnity insurance in place in accordance with the requirements of ICAEW. Our professional insurance cover is up to a maximum of £1,000,000 and is capped at this level.
